Can people file for bankruptcy more than once?
The short answer is yes.

Why do people file bankruptcy more than once?
There are numerous reasons for this. Sometimes, they are laid off or become ill and need to use the protection bankruptcy affords to seek a second fresh start.

Is there a limit to the number of times someone can file bankruptcy?
The short answer to this is no. The longer answer is that each person who files must qualify under the law. There are code provisions that prevent people who have received a bankruptcy discharge to seek relief in a new case for a period of years (4, 6, or 8 depending on the circumstances). There are also code provisions that discourage or prevent “chronic filing” or gaming of the system.

What should I know about filing multiple bankruptcies?
If you have already filed, whether or not you received a discharge, you should discuss your situation with a qualified attorney who will carefully evaluate your situation. An additional bankruptcy may be exactly what you need or there may be other solutions.

Keep in mind that bankruptcy is the opportunity to get a “Fresh Start”.
The Supreme Court defines the fresh start as: “[I]t gives to the honest but unfortunate debtor…a new opportunity in life and a clear field for future effort, unhampered by the pressure and discouragement of preexisting debt.” Bankruptcy is a powerful tool and should not be taken lightly. It is a good idea to seek credit repair and rehabilitation after your discharge.
